at about 600 p.m I was struck by a toyota suv. I was northbound on North dr at Sarno. I was in left turn lane preparing to turn left (west) on sarno. the SUV approached from the east to enter North Dr to go south. the suv approached the turn improperly and was actually in the oncoming (sarno eastbound) which caused him to hit my passenger side front bumper. I was at a complete stop on the stop line. My vehicle came to rest slightly with the front wheels forward of the stop line, but the rear wheels were still behind the line. My vehicle was still not in a position to block the eastbound sarno turn lane (for turns to North dr and nearby streets). At no time was my vehicle an obstruction to any traffic (other than the North dr left turn lane).

Immediately after the accident, literally within seconds, a FL state trooper happened upon the accident. I was still on the 911 call, being transferred from dispatch to melbourne PD. I provided my papers to the Trooper (Johnson), who processed the accident until melbourne arrived. The other driver tried to convince the trooper that I was at fault for being in (Sarno) traffic lane. The trooper stated that the vehicles locations provided contrary evidence. video record of this is available - HPIM4211.

several additional video records also show the other driver unsucessfully attempting to convince two Melbourne PD officers the same. both MPD officers stated that the other driver turned improperly and that evidence supported that the other driver was actually driving westbound in the sarno eastbound lane, not the westbound turn lane. there are video records of these discussions. the MPD officers stated that they were advised of multiple infractions by the other driver, but apparently MPD officers decided not to charge the other driver.
